The attorney for a Maryland first-grader who was suspended for pointing his fingers like a gun at school says the incident will be removed from the child's permanent record.

The boy, a student at Roscoe Nix Elementary School in Silver Spring, was suspended for one day for the incident that happened a week after the Sandy Hook Elementary shooting in Newtown, Conn.

The family's attorney, Robin Ficker, said the 6-year-old was playing with friends, not making threats.

"Evidently, he was pointing his finger at someone and saying, 'Pow,'" Ficker said.

In a letter dated Thursday, the school's prinicpal stated she would rescind the suspension and expunge the incident from the boy's record.
